Sometimes I discover the Finder is "using" the drive when it's showing a preview of a selected file on that drive. If you're trying to eject the drive, try making sure none of your Finder windows has that drive/file on that drive selected (or simply close them all first). Doesn't work all the time, but it sure is nice when it does ...
