I believe the Constitution doesn't say that, actually the House majority can elect a Speaker that is not a member of the House. Cruz could get elected as their asshat Speaker. They could elect Rush Limbaugh if they wanted.
Anyone consider that one motivation of the GOP to shut down the government on October 1 is to steal the headline that also on this day the ACA enrollment begins? No one will be talking about the biggest day yet for the ACA.
