I can't believe that! With that well known Apple secrecy, how could someone leave a prototype lying around in a bar? And if it's true, someone is in very deep caca! It's making the rounds all the way to CNN

However, in addition to the legal issues involved with buying stolen merchandise (which are in effect regardless of whether the buyer knows the goods are stolen or not), Gizmodo also faces legal consequences under California's Uniform Trade Secrets Act.
That'll teach them not to do this in the future, hopefully. While it's cool to see a prototype, Apple could lose a bit due to loss of surprise.

The question that I have is, why was the phone even off Apple's campus in the first place? Smuggled off? With Apple's security over new or updated products, there seems to have been a break in protocols with this incident. Something nefarious happened.

I suspect that the iPhone was going through real world testing , at lease I hope so , Apple used to test the pants off , of products before being released . Hence the clever cover case to mimic a 3GS .

Thats always a possibility . However tell me when did Apple really did have a surprise I mean all them rumor mills have come pretty dang close to the actual products in the past.
Anyway The cats out of the bag , Apple still can hype this more then before . The only problem is this time the competition has a head start but when you think about it the competition already has some of those features last year .
