Keep in mind that, if this technology really is on osx, it's with Apple's permission (and probably guidance). if this is the case, it would be on OS 10.5
I, for one, welcome our dock-on-the-top overlords.
You can easily set preferences manually (or with the aid of "hidden preferences" applications like OnyX) to put the dock on the top of the screen. This could very well be a technology running seamlessly under 10.4, maybe even the Intel version. There are already touch screen kits, so what would keep someone from making a multi-touch screen kit? However, considering how many OS X Dock clones there are, at least for Windows, there is no proof in that little video.
